Welcome to Boats.net! This Site is provided by Outdoor Network as a service to our customers. Using "The OutdoorNetwork" constitutes your unconditional agreement to the following terms and conditions (the "Terms of Service"). The OutdoorNetwork reserves the right to change or modify these Terms of Service at any time without prior notice to you. For this reason, please review these Terms of Service periodically.

Site Use
By accepting all these Terms of Service through the use of this Site, you confirm that you are 18 years of age or older. If you are under 18 but at least 13, you may use this Site only under the direction of a legal guardian who agrees to be held responsible by these Terms of Service. These responsibilities include all financial charges and legal liability that she/he may incur. If you do not agree to these Terms of Service, do not use this Site. Providing any inaccurate information may constitute a breach of the Terms of Service. You agree to pay for and accept the item by confirming your purchase at the end of the checkout process.

You should assume all materials (including text, images, illustrations, icons, designs, etc.) that are part of this Site are intended only for personal, non-commercial use. You may download one single hard copy of materials displayed on the Site for your personal use only, provided you do not change or delete the trademark or copyright on the Materials. All software used on this Site is the property of The OutdoorNetwork or its suppliers and protected by U.S. and international copyright laws.

Site Security
Users agree not to violate or attempt to violate the security of the Site, including, without limitation, (a) accessing data not purposed for such user or logging onto the server which the user has not been authorized; (b) attempt to explore the weakness of a system or network or to commit a breach in security or authentication without proper authorization; (c) attempting to interfere with service to any customer, host or network, including: submitting a virus to the Site, overloading, spamming, or crashing; (d) or do not send unsolicited emails (promotions and/or advertising of services or products. The OutdoorNetwork will look into occurrences that may be of such violations and may involve law enforcement authorities in pursuing criminal actions against those violators. You agree to use any software or device that would interfere with the structure of this Site or the activity being conducted on this Site.

Superceded Parts
All manufacturers, over time, supersede old parts for new ones. The main reason for doing so is to improve quality or fix imperfections without losing any of the functionality. All superseded items are in accordance with the specifications of the original item it was superseded from, but you might expect some minor differences in detail.

We have no control over a manufacturer's decision to supersede a part. Please note, in most cases if a superseded part is offered it is because the original part has been discontinued and is no longer available. If you do not want a superseded part or have any questions about availability, please notify us by email or by phone at the time of your order.

Order Liability
Please note there may be orders that we are unable to process and must cancel. We may refuse or cancel any order and reserve this right solely at our discretion. Remember that you will not be charged until the order is evaluated and an email confirmation sent informing you the order is being processed. These are some of the situations that may result in the cancellation of your order: limited quantities, inaccuracies in pricing or errors in the listed information, or problems with your credit card acceptance. Please note that we may require additional information before processing any order. We will contact you via email if any portion of your order has been canceled or if we need additional information to process the order. If your credit card has been charged and the order is canceled due to discontinuation or lack of availability of a part, we will credit the amount charged. We are not responsible for incorrect ordering of items due to the listing of incorrect information.

Oversized Items
Shipping fees are initially based on your order total during checkout. Once we process your order for shipment we will determine the actual dimensions, weight, destination, and carrier. At that time, we reserve the right to charge additional shipping fees and or cancel the order associated with oversized or heavy items, or any other limitations. If this happens, you will be contacted via email with instructions on how to proceed, along with an option to cancel your order.

Part Availability
While we do stock over $6 million in parts inventory, we may not have every part in stock. *Most orders will ship within 3-5 business days, depending on the items purchased, part availability, and the warehouse stock levels. While it is impossible to stock all items, we do try to stock all common items to ensure your fulfillment needs. We will automatically notify you of your order status with an estimated ship date via email once your order is processed. Please keep a copy of this email for future reference.

Order Canceling - Applies to Parts Only
We understand certain situations may arise where an order or parts off an order need to be canceled. Boats.net works extremely hard to fill orders in the shortest amount of time possible. Therefore, we ask that you notify us as soon as possible by sending an email to parts@boats.net or calling us at 1-877-408-1587. All orders canceled may be subject to a 15% restocking fee based on the specific parts ordered. This fee is based on 15% of the merchandise value. We will work hard to accommodate all customer needs, however, if the order has already entered the shipping process then it will be subject to these fees.
Q.Why is there a restocking fee?
A. There are two reasons for these fees: The shipping fee we encounter due to returning the unwanted part to the manufacturer and the cost of the restocking fee the manufacturer charges us. Boats.Net does absorb the shipping cost but we pass a portion of the restocking fee that the manufacturer charges us to the customer.
Q.Will I be charged the restocking fee if I am changing the part to the correct one?
A.You will not be charged a restocking fee for replacing the part or parts with the correct items needed, however, there are some exceptions (lower units, powerheads, gear cases, top cowlings, etc).
Q.How long do I have to cancel an order without being charged a restocking fee?
A.Once the order enters the shipping process the order is subject to restocking fees.

The OutdoorNetwork Pricing
The OutdoorNetwork tries to provide accurate product and pricing information; however, typographical errors may occur. The OutdoorNetwork will not confirm the price of the item until after the order has been submitted. If the item has been listed with incorrect pricing or the wrong information due to an error, The OutdoorNetwork has the right, at our sole discretion, to cancel any and all orders placed for that particular product. We will contact you via email to notify you of this error and inform you of the correction. The OutdoorNetwork strives to provide you with the best price possible. However, sometimes a product is lower at one of our competitor's. We will honor that competitor's price by matching it. The customer will be asked to provide written or photographed documentation to support such a claim for verification purposes.

Unauthorized Use
Unauthorized use of the materials is prohibited and is a violation of the rights of The OutdoorNetwork and/or third parties, including, without limitation, under copyright laws, trademark laws, the laws of publicity and privacy.

Browsing Use
Use of and browsing through the Site is done solely at the user's own risk. Neither The OutdoorNetwork nor any other party involved in creating, producing or delivering the Site shall be liable for any direct, secondary, substantial, roundabout or disciplinary damages arising out of your access to, or use of, or browsing the Site, or downloading any materials, data, text, images, video or audio from the Site, including, without limitation, damage to, or viruses that may infect, your computer equipment or other property as a result thereof.



Trademark
The Trademarks posted on the Site are registered and unregistered Trademarks of the Outdoor Network. Nothing enclosed on the Site should be construed as granting, by implication, any license or right to use any Trademark displayed on the Site, or a trademark owned by a third party. In the event that you misuse any Trademark in violation of these Terms and Conditions, The OutdoorNetwork will assertively enforce its property rights to the fullest degree of the law, including seeking criminal prosecution.
